These Terms of Use govern your access to and use of the Nister AI website, software, dashboards, automation services, onboarding flows, support channels, hosted environments, and related services provided by Nister AI Ltd (Nister AI, we, us, or our). By using the Services, you agree to these Terms.
1. Nature of the Services
Nister AI provides software, automation, infrastructure, monitoring, managed-capital service operations, and related tools for automated trading workflows. Starter runs through supported third-party broker environments. Managed Funds is the pooled managed-capital Forex service path.
Nister AI:
- is not a bank, broker, dealer, exchange, or trustee;
- does not accept broker deposits from Starter users;
- does not pool broker-account balances from Starter users;
- handles Managed Funds funding, allocation, trading, and payout operations only through the Managed Funds service path;
- does not guarantee profits or avoidance of loss; and
- does not provide personalized investment, legal, tax, or accounting advice.
2. Eligibility
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You have legal capacity to enter contracts.
- Your use is not prohibited by applicable law.
- You are not using the Services from restricted or sanctioned jurisdictions.
- Information you provide is accurate and complete.
3. No Financial Advice; No Performance Guarantee
Nothing on the platform, website, support communications, or promotional materials is financial, legal, tax, or investment advice. All trading involves risk, including the loss of capital.
4. Third-Party Brokers, Platforms, and Providers
The Services rely on third-party brokers, trading platforms, market data services, cloud hosting providers, and payment providers. We are not responsible for third-party outages, broker execution quality, policy changes, pricing behavior, solvency, or account actions.
5. User Responsibility and Account Control
You remain responsible for the service path you choose and for understanding all trading outcomes and risks.
- Selecting, funding, and monitoring your broker account when using Starter.
- Following Managed Funds funding, payout, identity, and support instructions when using Managed Funds.
- Securing your credentials and devices.
- Choosing and maintaining risk limits, activation status, and broker-account monitoring.
- Maintaining hardware, internet, power, terminal access, and the Nister AI App for Starter.
- Complying with applicable law, broker rules, and tax obligations.
6. Starter and Managed Funds
Starter
Starter runs through your own broker account and local environment. Continuity depends on your device, terminal, internet, power, and Nister AI App runtime. We are not liable for missed trades or downtime caused by local environment failures.
Managed Funds
Managed Funds is the pooled managed-capital Forex service path. Monthly profit payout operations occur only when trading results support them. Managed Funds does not guarantee uninterrupted service, successful execution, fixed monthly returns, or profitability.
7. Subscription, Billing, and Fees
- Fees are billed in advance for each billing cycle.
- Starter subscription payments buy platform access, software/runtime access, and support. They are not broker deposits or trading capital.
- Managed Funds subscription payments buy Managed Funds service access. Managed-capital funding, trading allocation, and payout handling may be handled separately through account support and plan-specific instructions.
- When crypto payment is offered, you must send the exact token, amount, network, and invoice reference shown during checkout, then submit the sender wallet and transaction hash for review.
- Incorrect token, network, amount, wallet, or transaction details may delay or prevent payment approval.
- Prices may change with notice.
- Failure to pay may lead to suspension or termination.
- Unless required by law or stated otherwise, fees are non-refundable.
8. Trials, Promotions, and Beta Features
We may change or withdraw trials, promotions, and beta features at any time.
9. Acceptable Use
You may not misuse, reverse engineer, exploit, or use the Services for unlawful activity.
10. Intellectual Property
The Services and related materials are owned by or licensed to Nister AI. You receive a limited, revocable, non-transferable license to use the Services under these Terms.
11. Communications
We may contact you about onboarding, billing, support, security, and operational updates.
12. Privacy
Your use of the Services is also governed by our Privacy Policy.
13. Service Availability; Changes
We may modify, suspend, discontinue, or restrict portions of the Services for maintenance, legal, security, or operational reasons.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided as-is and as-available without warranties of merchantability, fitness, non-infringement, uninterrupted availability, or guaranteed outcomes.
15. Limitation of Liability
To the maximum extent permitted by law, Nister AI is not liable for indirect, incidental, consequential, special, exemplary, or punitive losses, including loss of capital, profit, data, or opportunity arising from use of the Services, market losses, third-party failures, or execution differences.
Aggregate liability is limited to subscription fees paid in the three (3) months before the event giving rise to a claim, except where liability cannot be lawfully excluded.
16. Indemnity
You agree to indemnify Nister AI against claims arising from your use, violations, or unlawful acts.
17. Suspension and Termination
We may suspend or terminate access for breach, non-payment, abuse, legal risk, fraud, or operational or security concerns.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of Cayman Islands. Disputes are submitted to the courts of George Town, Cayman Islands, unless mandatory law requires otherwise.
19. Changes to These Terms
We may update these Terms from time to time. Continued use after updates take effect means you accept the revised Terms.
